The US Senate has voted to block a rule that would have given the White House greater control over federally funded research, according to reporting in the journal Science.

The vote is technical, and its consequences are not.

What a “rule” is

Most government action does not happen through laws passed by legislators. It happens through rules — detailed regulations written by agencies under authority a law has already granted them.

Rules carry legal force. They are also faster to make than legislation, and faster to undo, which is why so much policy now moves through them. Congress retains mechanisms to block rules it objects to, and this vote used one.

Why research funding is politically sensitive

The federal government is the largest funder of basic scientific research in the United States. Which projects receive money is normally decided through peer review — panels of working scientists assessing proposals on scientific merit.

Peer review is slow and imperfect. Its defenders argue it is nonetheless the least bad method available, because the alternative is funding decided by whoever currently holds office.

That is the argument at the centre of this dispute: whether elected officials should have more say over what gets studied, or whether distance between politics and funding decisions is worth protecting.

How rules are made, and unmade

The process has recognisable stages. An agency drafts a proposed rule and publishes it. A comment period follows, during which anyone — companies, universities, advocacy groups, individuals — can submit objections. The agency is required to consider those and then issues a final rule.

Congress retains a check on this. Under a mechanism that allows legislators to disapprove of recently issued rules, a simple majority in both chambers can nullify one, though the president may veto that disapproval.

The result is a system where a great deal of consequential policy is made and reversed without a single new law being passed — and where the same rule can be issued, blocked, reissued in modified form and litigated over several years.

What peer review does and doesn’t do

Peer review is worth understanding properly, because both sides of this argument invoke it.

When a scientist applies for funding, the proposal is assessed by a panel of researchers working in the same field. They judge whether the question matters, whether the method is sound, and whether the applicant can realistically carry it out. Ranked results are then passed to the agency, which allocates money.

Its documented weaknesses are real. Panels tend towards caution, favouring incremental proposals over genuinely novel ones. Established researchers do better than newcomers. Fashionable topics attract disproportionate funding. Reviewers are not immune to the assumptions of their own field.

What it does provide is a barrier between funding decisions and whoever currently holds office. That is the property under discussion — not whether peer review is ideal, but whether removing that barrier improves matters or makes them considerably worse.

The case each side makes

Those favouring more political control argue that public money should answer to the public. Scientists are not elected; taxpayers fund the work; and elected representatives are entitled to set priorities. They also point to fields where they believe consensus has hardened prematurely.

Those opposing it argue that research which is politically inconvenient is exactly the research most likely to be defunded — and that findings become untrustworthy once the funding depends on producing acceptable results. They note that the value of basic research is frequently invisible for decades.

Both positions contain something real. The disagreement is about which risk is worse: research disconnected from public priorities, or research shaped by whoever is in power.

Why it matters outside the United States

American federal funding underwrites a large share of the world’s basic research, and its outputs — published openly — are used everywhere. Changes to how it is allocated do not stay within one country’s borders.

A Senate vote blocking a rule is not the end of the argument. Rules can be rewritten, and the underlying dispute over who decides what gets studied is not close to settled.
